The Subscriber therefore expressly agrees that, in the event of a breach or threatened breach of the Agreement or any part thereof by the Subscriber, ABS-CBNI shall, at its discretion, be entitled to injunctive and other equitable relief against the Subscriber to end or prevent such breach and to secure enforcement of the Agreement. Resort to such equitable relief, however, shall not be construed as a waiver of any other rights or remedies that ABS-CBNI may have for damages or other relief. In any action brought by ABS-CBNI to enforce its rights under the Agreement in which ABS-CBNI substantially prevails, ABS-CBNI shall be entitled to recover its costs of bringing such action, including reasonable attorneys’ fees.
